Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of all DialPhone, Inc. ("DialPhone") services, including voice, messaging, video, fax, AI tools, and related features (collectively, the "Services"). This AUP is part of and incorporated into our Terms of Service.
1. General Conduct
You agree to use the Services responsibly and in compliance with all applicable local, state, national, and international laws and regulations. You are responsible for ensuring that all users under your account comply with this policy.
2. Prohibited Uses
You may not use the Services to:
- Spam or Unsolicited Communications: Send unsolicited bulk messages, robocalls, or communications that violate CAN-SPAM, TCPA, or equivalent legislation.
- Fraud or Deception: Engage in caller ID spoofing for fraudulent purposes, phishing, impersonation, or any form of deceptive communication.
- Harassment: Threaten, stalk, harass, or intimidate any person or entity.
- Illegal Activity: Facilitate or promote any illegal activity, including but not limited to trafficking, money laundering, or distribution of illegal content.
- Do-Not-Call Violations: Contact individuals or entities on the National Do-Not-Call Registry or similar lists without proper consent or exemption.
- Network Abuse: Attempt to disrupt, overload, or interfere with the Services or other users' access, including denial-of-service attacks.
- Unauthorized Access: Access or attempt to access accounts, systems, or data without authorization.
- Malware: Transmit viruses, worms, trojans, or other malicious code through the Services.
- Resale Without Authorization: Resell or redistribute the Services without a valid reseller or partner agreement.
3. Regulatory Compliance
Users are responsible for complying with all applicable telecommunications and data protection regulations, including but not limited to:
- TCPA: Telephone Consumer Protection Act requirements for automated calls and texts
- GDPR: General Data Protection Regulation for EU data subjects
- CCPA: California Consumer Privacy Act requirements
- HIPAA: Health Insurance Portability and Accountability Act for healthcare communications
- FINRA: Financial Industry Regulatory Authority requirements for financial services
- PCI-DSS: Payment Card Industry Data Security Standard for payment information
4. Content Standards
You are solely responsible for all content transmitted through the Services. Content must not contain material that is defamatory, obscene, infringing on intellectual property rights, or otherwise unlawful. DialPhone does not monitor content but reserves the right to review and act on reported violations.
5. Resource Usage
You agree to use the Services within reasonable usage limits. Excessive use that negatively impacts service quality for other users may result in throttling or additional charges. Specific usage limits are defined in your subscription plan.
6. Monitoring and Enforcement
DialPhone reserves the right to:
- Monitor usage patterns for compliance (without reviewing communication content)
- Investigate reported violations of this AUP
- Take corrective action, including warnings, temporary suspension, or permanent termination
- Report illegal activities to appropriate law enforcement authorities
- Cooperate with law enforcement investigations when required by law
7. Consequences of Violation
Violations of this AUP may result in:
- First offense: Written warning and requirement to remedy the violation within 48 hours
- Repeated offenses: Temporary service suspension pending investigation
- Severe violations: Immediate account termination without refund
- Legal action: Pursuit of damages and legal remedies where applicable

We take all reports seriously and will investigate within 24 hours of receipt.
9. Changes to This Policy
DialPhone may update this AUP at any time. Material changes will be communicated via email or in-platform notification at least 30 days before they take effect. Continued use of the Services after changes become effective constitutes acceptance of the revised policy.
